Drama ensued late last week. On Friday around noon, the highly popular digital payment platform Paytm suddenly disappeared from the Google Play Store for Android phones, at least in India. Not that this meant that existing Paytm users could no longer use the app (because they could), nor did it mean that transactions stopped (because they didn’t). It just meant you couldn’t update or download the Paytm app again (but who doesn’t already have Paytm on their phone?). But it pointed to something that was troubling on a larger scale. What was wrong with the Paytm app that warranted such a move by Google? Both companies have their own side of the story to share. It turns out that Google categorized some cashback and scratchcard offers that Paytm offered users ahead of the much-awaited IPL 2020 T20 cricket season as gambling and sports betting. But it’s clearly not as black and white as it’s made out to be.
In a statement shared this morning, Google India said: “The mere offering of cashback and vouchers does not constitute a violation of our Google Play gambling policies. Last week, we reiterated our Play Store gambling policies. Our policy does not allow online casinos and does not support unregulated gambling apps that facilitate sports betting, including daily fantasy sports in India.” Google India confirms that the policies are enforced to ensure a safe consumer experience.“For repeated policy violations, we may take more serious action, which may include termination of developer accounts on Google Play. Our policies are applied and applied consistently to all developers,” they add.
Paytm says that the first message they received from Google says that the Paytm app has been removed from the Play Store in India. Obvious issues highlighted include UPI cashbacks and the scratch card campaign Paytm was running then before the launch of the IPL 2020 T20 cricket extravaganza. Paytm confirms that Google did not give them an opportunity to respond, which is usually the norm. “This was the first time that Google sent us a communication regarding our UPI cashback and scratchcard campaign. Contrary to normal practice, we have not been given an opportunity to address their concerns or present our views,” Paytm said in an official statement. They also adds, “We claim that our cashback campaign follows the guidelines as well as all laws of the country. We didn’t break any rules and it wasn’t a crime. It has nothing to do with games.”
A quick look at the global Google Play Store policy, which specifically addresses what it describes as “ads for gambling or real money games, contests and tournaments in apps distributed by Play,” indicates that the company does not allow advertising for gambling, Real cash games and contests and tournaments are allowed where local laws of the venue allow. In addition, the ads must not be shown to users under the age of 18 and the app must not be enrolled in the Designed for Families program. It is currently not clear whether Paytm has signed up for this program.
A quick browse through the Google Play Store listings in India seems to tell its own tale of confusion. A simple search for “Fantasy Cricket” in the Play Store for Android phones brings up apps including Fantasy Cricket, CricPlay – India’s First Free Fantasy Cricket Game, Team11Fantasy – Free Fantasy Cricket and more. While these apps don’t always allow transactions or fantasy league play, they certainly promote such activities. However, it is interesting to note that Dream11, the title sponsor of this year’s IPL 2020 tournament and Mobile Premier League, or MPL, the main sponsor of Kolkata Night Riders, have Android apps but provide direct links to download and follow how-to steps for apps on Android devices side by side – and not through the official Google Play Store.
It may not come as a surprise to you that Google Pay in India also wanted to capitalize on the excitement of cricket’s return with IPL 2020. Google Pay ran its own ‘Tez Shots’ campaign with rewards of up to Rs 1 lakh – and they would earn rewards based on results for different services they use on Google Pay. Google Pay competes with Paytm in digital payments in India. It is not clear whether Google has different policies for its own apps, or whether Google uses different age demographic and location filters for content shown to users in its apps.
Paytm also points out that Google India has also raised a policy violation in the past when Paytm advertised its own subsidiary, Paytm Games, on the app. However, Google India had no problem when Paytm Games was promoted with paid promotions on the YouTube platform.
In June, research and strategy firm Zinnov released data suggesting that Paytm has 39 million daily active users (DAUs) in the country, while Google Pay registers around 19 million DAUs.
